The TAKE IT DOWN Act amends the Communications Act of 1934 to criminalize the intentional disclosure of nonconsensual intimate visual depictions, including digital forgeries, through interactive computer services. It establishes a framework for identifying and removing such content from covered platforms, defining key terms and setting forth specific offenses and exceptions. The Act mandates covered platforms to create a notice and removal process, with the FTC responsible for enforcement. The bill also includes penalties for violations, as well as forfeiture and restitution provisions. This act seeks to protect individuals from the harms associated with the online dissemination of nonconsensual intimate images.1
