The latest attempt by Washington politicians to federalize elections, H.R. 4, would make unelected bureaucrats including Merrick Garland in President Joe Biden’s Department of Justice (DOJ) the arbiters of election law. This bill would require every state to get the Biden DOJ’s permission to implement overwhelmingly popular election integrity reforms like voter ID by resurrecting antiquated pre-clearance requirements. For states like Florida, Georgia, and Arizona that are leading the way on election integrity, H.R. 4 punishes them by requiring any changes in election law to be approved by Biden’s DOJ.
Biden’s DOJ is demonstrably hostile to state election integrity reforms. In June, Attorney General Merrick Garland announced that Biden’s DOJ would be launching a lawsuit against Georgia for the state’s election integrity legislation. To give Biden’s partisan DOJ authority over state election laws is a dangerous and unacceptable proposition.
H.R. 4’s nationwide pre-clearance requirements are an unprecedented power grab that undermines the authority of states to run their elections. Election integrity remains a priority for Americans, and it is not the role of the Washington swamp to prevent duly elected state legislatures from serving their constituents.
Attempts to federalize our elections and stymie widely popular election integrity reforms run counter to the constitutional structure of our government; our elected officials must oppose H.R. 4 and protect our institutions.

John R. Lewis Voting Rights Advancement Act of 2021

The “For the People Act,” should be titled as the “For the Politicians Act” as it attempts to improve chances of election victories for Democrat politicians at the federal, state and local levels. The bill contains countless provisions which weaken election integrity and promote vote fraud such as same-day, online and automatic voter registration. The bill also imposes a myriad of new campaign finance disclosure requirements and even makes Election Day a federal holiday. ACU opposes this partisan political ploy which infringes free speech, disenfranchises legitimate voters by increasing the risk of voter fraud and opposed this bill.

This legislation would require universal background checks for all firearm sales, including private sales, with specific exceptions. This is a misguided effort, as universal background checks would do little to prevent violence and would only make it more difficult for law-abiding citizens to purchase, own, carry, and use a firearm.

The National Origin-Based Antidiscrimination for Nonimmigrants (NO BAN) Act weakens national security by largely stripping the President of the authority to restrict travel from countries due to the addition of “religion” as a protected characteristic under the Immigration and Nationality Act. The bill is in response to President Trump’s efforts to combat terrorist activities by instituting travel bans on the countries of Chad, Iran, Iraq, Libya, North Korea, Syria, Venezuela, and Yemen, which the Left has characterized as a “Muslim ban.”

The American Dream and Promise Act of 2021 rewards immigrants who entered the country illegally as minors with amnesty and full access to taxpayer-funded benefits. Under the bill, immigrants who entered the country prior to 2021 when they were supposedly under the age of 18, are provided a pathway to citizenship, including voting rights and eligibility for welfare and subsidized college. The bill even grants amnesty to immigrants with criminal histories (up to two misdemeanor offenses.)

American Dream and Promise Act of 2021

This bill would ultimately provide amnesty by creating a new “certified agricultural worker” status for which only illegal immigrant agricultural workers would be eligible. To qualify for this new status, individuals must be here illegally, as the bill states eligible aliens must be “inadmissible or deportable from the United States on the date of the introduction of this Act.” Furthermore, once this status has been granted to an individual, their children and spouses can then be granted “certified agricultural dependent” status leading to an exponentially larger population of illegal immigrants being granted amnesty.

Farm Workforce Modernization Act of 2021

The CHIPS Act subsidizes the semiconductor industry to the tune of $76 billion. This bill creates new federal grant programs and does nothing to help American industry compete against China in the long term. As the Wall Street Journal put it earlier this week, “competing with China is the new excuse for corporate welfare.”The American semiconductor industry is going to need much more than a $52 billion subsidy to compete against China’s semiconductor industry.
Additionally, Congress is offering a 25% tax credit with an estimated cost of $24 billion over the next 5 years.
That’s a total of $76 billion of corporate welfare for one industry.
Importantly, the U.S. already leads in chip design (52%) and chip-making equipment (50%). Injecting billions of dollars of corporate welfare into the industry is short-sighted and undercuts free enterprise.
Corporate welfare does not make America more competitive; It only increases government dependence. Instead, lawmakers should be looking at reducing the regulatory and tax burdens that drove American businesses offshore in the first place.

Supreme Court Security Funding Act of 2022

The OCC’s 2020 True Lender Rule sought to provide regulatory certainty to banks and third-party processors on who is the “true lender” when issuing short-term loans and to support the availability of responsible credit for people who need it most. The Federal Reserve estimates that 76 million Americans only make enough to cover monthly expenses and cannot save for contingencies.Short-term loans are a lifeline to millions of families across our country. By repealing the True Lender rule, Congress would be restricting access to quality credit and incentivizing families to turn to more expensive or harmful options such as bank overdrafts, late fees, or borrowing against their car or home.
It is challenging for individuals who don’t have great credit to get a loan from a national bank. Nearly 30% of hardworking Americans are unbanked or underbanked, and consumers with credit scores under 680 are rejected for loans from banks at four times the rate as those with scores above 680.
These loans have been a much-needed resource to underserved communities, and by repealing this rule, Congress would only be hurting the same communities they claim to protect. I urge you to support a free relationship between borrowers and lenders and to oppose the repeal of the True Lender Rule.

This massive bill includes $1,400 checks for all individuals earning under $75,000 and further extends the $300 weekly federal unemployment benefits throughout the summer.

The Congressional Budget Office estimated that the massive $1.9 trillion legislation would increase the deficit by nearly $1.86 trillion over 10 years. This deficit requires the Office of Management and Budget to enforce PAYGO rules and make cuts on federal programs, including Medicare.Democrats will argue that this bill is needed to prevent cuts to Medicare; however, they will not tell you that the only reason we are in this position is because the Democrats did not consider the budgetary implications of passing their $1.9 trillion socialist giveaway. Instead, Nancy Pelosi preferred to engage in a hyper-partisan process that prioritized bailing out oppressive, blue states that have only kept businesses closed and children out of classrooms for more than a year.
To make matters worse, only 9% of the $1.9 trillion was actually targeted for combating COVID-19. Our nearly-$30 trillion national debt is a threat to our national security, and passage of H.R. 1868 will only take us deeper into the unsustainable path to fiscal calamity.
Members of Congress must reject any vote that perpetuates and validates the acts of our fiscally irresponsible congressional leadership. This bill is nothing more than a rubber stamp for the Democrats’ fiscally irresponsible ways.

This massive $617 billion package combines seven of the federal government’s twelve annual spending bills. Contained in this monstrous package are radical left-wing social and environmental justice priorities and a dramatic increase in the size and scope of the federal government. Lawmakers have a responsibility to their constituents to reject this irresponsible collection of spending and defend fiscal conservatism.
At the forefront of this spending package is progressive climate change priorities. If passed, the Interior, Environment, and related agencies section would balloon to $43.4 billion, a more than 20% increase; included in this increased cost is $248 million in “environmental justice” programs. The bill’s $29.1 billion Financial Services section would also send a whopping $300 million to the Electric Vehicle Fund.
Despite years of subsidies and tax credits, electric vehicles remain an expensive luxury purchased only by the financially well-off. While everyday Americans are struggling with a dramatic rise in gas and grocery prices, politicians instead focus on propping up luxury vehicles.
This spending package puts left-wing priorities ahead of the needs of everyday Americans who are looking to shrink the role of government in their lives. Lawmakers in Washington must look to solutions that create more freedom and opportunity by getting the government out of the way rather than continue the tired tax and spend policies.

Although the nascent Biden administration has had a message of “unity,” the use of budget reconciliation means that bipartisanship is being cast aside to advance a partisan agenda.Budget reconciliation is a special, fast-track legislative process tied to a budget resolution that instructs specific committees to produce legislation tied directly to revenues, direct outlays, and/or the statutory limit on the debt held by the public. The process begins with the passage of a budget resolution with reconciliation instructions to committees to make changes based on certain dollar amounts.
Legislation that is produced from this process is given privilege in the Senate. This means the normal 60-vote cloture threshold to limit debate does not apply. Budget reconciliation cannot be used to make changes to Social Security. Policy changes that do not directly impact revenues and outlays risk the legislation losing its privileged status in the Senate. This is known as the “Byrd Rule,” named after Sen. Robert Byrd (D-W.Va.), laid out as federal statute in 2 U.S.C. 644.
The Biden administration and congressional Democrats plan to use budget reconciliation for a $1.9 trillion proposal that’s framed as another round of COVID-19 relief. However, this proposal comes only weeks after Congress attached a COVID-19 relief bill to the omnibus. President Biden’s proposal includes another, larger round of direct payments, an increase in unemployment benefits, a bailout of state and local governments, and an increase in the minimum wage to $15 per hour.
Although much of the spending that President Biden wants to ram through Congress on a partisan basis can be done within the confines of budget reconciliation, other elements have traditionally not been allowed in budget reconciliation. Increasing the minimum wage is an example of a provision that shouldn’t be used in budget reconciliation. However, far-left Democrats have expressed a willingness to shatter long-held precedent by using their narrow partisan majority in the Senate to overrule the “Byrd Rule.”

This bill throws billions of dollars at left-wing projects, is out of touch with the needs of everyday Americans, and gives the cover of “bipartisanship” to radical progressives that are currently pushing a massive $3.5 trillion budget resolution by a party-line vote.Advancing President Biden’s misguided climate agenda, the Infrastructure Investment and Jobs Act spends a combined $15 billion on electric vehicle (EV) infrastructure, electric buses, and other transit. This spending includes the construction of half a million new EV charging stations.

This bill also spends a whopping $65 billion on rural broadband infrastructure. While bridging the digital divide is certainly a worthy goal, reckless government spending is not the solution

The so-called LGBTQ Business Equal Credit Enforcement and Investment Act saddles banking and lending firms with even greater regulatory costs and serves as yet another tool for plaintiff attorneys to advance frivolous litigation. Specifically, the bill forces financial institutions to collect and report application data regarding LGBTQ owned businesses under the Consumer Financial Protection Bureau’s fair lending laws.

The so-called Paycheck Fairness Act serves as a new mechanism to enrich greedy plaintiff attorneys through frivolous litigation. Under the bill, employers are prohibited from asking about an applicant’s salary history and must abide by multiple new mandates when determining wages for prospective employees. Additionally, the resolution forces employers to turn over detailed private wage data to the government.

Paycheck Fairness Act

This resolution would simultaneously provide continuing appropriations for federal functions after the expiration of the fiscal year on October 1st, and suspend the debt limit to allow the Treasury to finance these appropriations through continued borrowing.As the end of the fiscal year rapidly approaches, Congress is asleep at the wheel. Instead of doing their job and fulfilling their primary responsibility of passing a federal budget, Congressional Democrats are seeking to kick the can down the road yet again. In the midst of reconciliation, fiscal conservatives should be appalled by the audacity Speaker Pelosi and Majority Leader Schumer have shown with this legislation.
It has been a quarter of a century since Congress did its job and passed a complete budget through the statutory process before the end of the fiscal year. The past 25 years have seen five presidential administrations and numerous flips in Congressional control, yet the result is always the same. Seemingly incapable of meeting a deadline, Congress continually uses budgetary gimmicks like this Continuing Resolution to absolve themselves of their constitutional responsibility.
To make matters worse, Congressional Democrats seek to tie continuing federal appropriations to a suspension of the debt limit. With our total national debt rapidly approaching an incomprehensible $29 trillion, this provision alone should be a poison pill for any self-respecting Republican.

The George Floyd Justice in Policing Act of 2021 serves as an all-out attack on law enforcement and would have tremendous negative consequences on local communities and public safety. The bill contains numerous provisions that would expose officers to such great criminal and legal liabilities that they would be unable to properly carry out their duties as public servants. Additionally, the bill would essentially federalize local police departments, while doing nothing to address collective bargaining agreements which protect bad cops by making it nearly impossible to fire them.

George Floyd Justice in Policing Act of 2021

The PRO Act is one of the most anti-worker and anti-business bills that we have ever seen brought to the House floor, and is an updated version of the PRO Act passed along a near-party line vote during the last Congress in February 2020. The PRO Act is a giveaway to labor unions that would harm our economy and would especially target workers who choose not to join unions. Notably, it would do so by undermining all 27 states — more than half of the country — that have right-to-work laws. Federally coercing all private-sector workers to pay fees to labor unions violates individuals’ First Amendment rights and threatens the increased employment rates commonly seen in right-to-work states. The only thing that this bill is “PRO” is pro-union.
It also attempts to apply to the whole country a horrific standard set by California, of all states, regarding worker classification. The PRO Act would codify California’s disastrous “ABC” test that determines whether a worker is an employee or an independent contractor. This law throttles the gig economy by making it more difficult for companies to contract with individuals. It should be noted that many independent contractors prefer their status to being a full-time employee.

Furthermore, the PRO Act undermines privacy for workers by mandating that employers share their employees’ personal information with unions, with few to no restrictions on what unions can then do with the employees’ information. Such a prospect is terrifying. Needless to say, the PRO Act would do nothing but undermine the rights of workers it claims to help. This is par for the course for the progressive left that has long bowed to the whims of labor unions.

This resolution impeaches President Donald John Trump for high crimes and misdemeanors.

Specifically, the resolution sets forth an article of impeachment stating that President Trump incited an insurrection against the government of the United States.

The article states that

prior to the joint session of Congress held on January 6, 2021, to count the votes of the electoral college, President Trump repeatedly issued false statements asserting that the presidential election results were fraudulent and should not be accepted by the American people or certified by state or federal officials;
shortly before the joint session commenced, President Trump reiterated false claims to a crowd near the White House and willfully made statements to the crowd that encouraged and foreseeably resulted in lawless action at the Capitol;
members of the crowd, incited by President Trump, unlawfully breached and vandalized the Capitol and engaged in other violent, destructive, and seditious acts, including the killing of a law enforcement officer;
President Trump's conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the presidential election, which included a threatening phone call to the Secretary of State of Georgia on January 2, 2021;
President Trump gravely endangered the security of the United States and its institutions of government, threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of government; and
by such conduct, President Trump warrants impeachment and trial, removal from office, and disqualification to hold U.S. office.

This bill is nothing more than a vehicle for Leader Chuck Schumer to fast track legislation to federalize our elections and eventually dismantle the legislative filibuster.Now that it has been revealed that a bipartisan majority of senators oppose President Biden’s Big Government Socialism Bill, Democrats are pivoting to federalize our elections and are willing to transform the world’s greatest deliberative body into a rubber stamp for the White House to accomplish it.
Amid a barrage of conspiracy theories and falsehoods by fear-mongering, Democrats are once again pushing the John Lewis Voting Rights Advancement Act and Freedom to Vote Act, a supposed compromise bill.
The John Lewis Voting Rights Advancement Act would require every state to get the Biden Department of Justice’s permission to implement overwhelmingly popular election integrity reforms like voter ID by resurrecting antiquated pre-clearance requirements. Essentially this would make unelected partisan bureaucrats like Attorney General Merrick Garland the king of United States election laws.
The Freedom to Vote Act is no compromise at all. It is nearly identical to H.R. 1, better known as the “Corrupt Politicians Act.” If passed, this bill would facilitate a federal takeover of our elections, attack the First Amendment, and funnel taxpayer dollars to the reelection campaigns of career politicians.
Under no circumstances should Democrats be allowed to dismantle the institutions of our Republic and undermine the integrity of our elections. States like Georgia, Texas, Florida, and Arizona are leading the way to secure our elections; we should be embracing their reforms rather than working to dismantle them.

The Bipartisan Safer Communities Act (S. 2938) is a package of different gun control proposals stitched together with school safety and mental health provisions. As usual for Congress these days, the bill was negotiated and written by a small group of senators in secrecy, with the rest of the Congress expected to vote on the sweeping legislation just days after receiving the text. Expecting members to understand the impacts of an 80-page bill in just 72 hours is irresponsible, not to mention the fact that it prevents the American people from weighing in on the package and having their voices heard. That seems to be by design.

The House voted on a package of eight gun control bills, combined into H.R. 7910, the so-called “Protecting Our Kids Act.” This partisan package chips away at the Second Amendment and seeks to disarm law-abiding Americans by imposing new restrictions and legal burdens. These new burdens will do little to prevent future acts of violence, likely wouldn’t have had any impact on previous shootings, and would only restrict Americans’ constitutional right to bear arms.

This bill prohibits the future sale of new so-called “assault weapons” and “high-capacity magazines” to civilians, with exceptions for law enforcement, including those who are retired and off-duty. At its core, the Postal Service Reform Act is a $58 billion taxpayer bailout for the fiscally-insolvent United States Postal Service (USPS). The Postal Service Reform Act would repeal a requirement in 5 U.S. Code 8909a(d) that the USPS make annual payments to the Retiree Health Benefits Fund, from which benefits are paid to retired workers. The Postal Service Reform Act essentially sets up taxpayers to bail out this fund.

The process for this omnibus is the epitome of everything that is wrong with Congress. This massive, 2,741-page spending measure was negotiated behind closed doors, released in the dead of night, and will be voted on without sufficient time to read. This is yet another example of how broken our appropriations process has become as it emboldens Democrat and Republican leadership to continue spending and leaves the American people in the dark.In total, the bill authorizes more than $1.5 trillion in annualized discretionary spending for fiscal year 2022. This amounts to a 6% increase in discretionary spending–not counting emergency supplemental spending–and will total an additional $880 billion over 10 years.
Working Americans are hurting as inflation reaches its highest levels in 40 years, coupled with record-high gas prices stemming from President Biden’s failed energy policy. Instead of fighting for less government and cutting agency spending, the bipartisan establishment in Congress doubled down on federal spending policies that will only perpetuate the inflation crisis.
This bill also includes billions of dollars in emergency funding that is not subject to budget caps. Lawmakers making the case that this spending is vital should be pushing to let it pass alone and on its own merits, not attached to supposed “must-pass” legislation.
Lawmakers are doing a disservice to the American people by pushing through this irresponsible spending package that no one has read. Between skyrocketing inflation and record-setting debt, the last thing we need is another reckless spending binge, yet that is exactly what the Washington Swamp is ready to do.

Democrats are using reconciliation, a special legislative process, to jam the package through on a purely partisan basis. The bill proposes nearly $570 billion in new taxes, while increasing spending by roughly $580 billion over the next decade—plus an additional $200 billion after accounting for budget gimmicks.

Pharmacy benefit managers (PBMs) play a significant role in the dramatic rise in the cost of prescription drugs. PBMs are third-party administrators determining which drugs go on formularies (a list of approved prescription drugs that hospitals can prescribe and are covered under an insurance policy). Ostensibly, PBMs negotiate to obtain the best price. However, these “savings” are often pocketed by PBMs themselves and aren’t passed onto patients. Since they are reimbursed based on the markdown from the original list price, PBMs are incentivized to prioritize drugs with higher list prices, so they can receive a larger markdown. This legislation is a simplistic proposal to address a highly complex problem. We cannot afford half-hearted proposals based on unsound economics like this one for an issue that impacts so many.

This resolution temporarily establishes in the House of Representatives the Select Subcommittee on the Weaponization of the Federal Government, which is comprised of not more than 13 Members appointed by the Speaker (5 of whom shall be appointed in consultation with the minority leader). The subcommittee must investigate matters related to the collection, analysis, dissemination, and use of information on U.S. citizens by executive branch agencies, including whether such efforts are illegal, unconstitutional, or otherwise unethical. The subcommittee must make a final report of its findings by January 2, 2025, and terminates 30 days after filing that report.

Establishing the Select Committee on the Strategic Competition Between the United States and the Chinese Communist Party

This bill prohibits the sale and export of crude oil from the Strategic Petroleum Reserve (SPR) to China. Specifically, the bill prohibits the Department of Energy (DOE) from selling petroleum products (e.g., crude oil) from the SPR to any entity that is under the ownership, control, or influence of the Chinese Communist Party. Further, DOE must require as a condition of any sale of crude oil from the SPR that the oil not be exported to China.

Protecting America’s Strategic Petroleum Reserve from China Act

This bill establishes requirements for the degree of care a health care practitioner must provide in the case of a child born alive following an abortion or attempted abortion. Specifically, a health care practitioner who is present must (1) exercise the same degree of care as would reasonably be provided to any other child born alive at the same gestational age, and (2) ensure the child is immediately admitted to a hospital. Additionally, a health care practitioner or other employee who has knowledge of a failure to comply with the degree-of-care requirements must immediately report such failure to law enforcement. A health care practitioner who fails to provide the required degree of care, or a health care practitioner or other employee who fails to report such failure, is subject to criminal penalties—a fine, up to five years in prison, or both. An individual who intentionally kills or attempts to kill a child born alive is subject to prosecution for murder. The bill bars the criminal prosecution of a mother of a child born alive under this bill and allows her to bring a civil action against a health care practitioner or other employee for violations.

Born-Alive Abortion Survivors Protection Act

This bill limits the drawdown of petroleum in the Strategic Petroleum Reserve (SPR) until the Department of Energy (DOE) submits to Congress a plan to increase the percentage of federal lands leased for oil and gas production. Specifically, the bill prohibits DOE from drawing down petroleum in the SPR for nonemergency purposes until it submits a plan to increase the percentage of federal lands, including submerged lands of the Outer Continental Shelf, that are leased for oil and gas production to offset any drawdowns on or after January 21, 2021.

The rule requires health care providers, as a condition of Medicare and Medicaid participation, to ensure that staff are fully vaccinated against COVID-19.

This bill requires each executive agency to reinstate the telework policies that were in place on December 31, 2019. Specifically, the bill prohibits employees of executive agencies or who are otherwise in the competitive service from (1) using their official authority to censor a private entity; or (2) engaging in censorship of a private entity while on duty, wearing a uniform, or using official government property. The bill provides certain exceptions for law enforcement, subject to specified reporting requirements.  Employees are subject to disciplinary action, civil penalties, or both for violations. The bill defines censor or censorship to mean influencing or coercing, or directing another to influence or coerce, for the removal of lawful speech, the addition of disclaimers, or the restriction of access with respect to any interactive computer service (e.g., social media).

This bill requires the National Telecommunications and Information Administration to examine and report on the cybersecurity of mobile service networks and the vulnerability of these networks and mobile devices to cyberattacks and surveillance conducted by adversaries.
The report shall include (1) an assessment of the degree to which providers of mobile service have addressed certain cybersecurity vulnerabilities; (2) a discussion of the degree to which these providers have implemented cybersecurity best practices and risk assessment frameworks; and (3) an estimate of the prevalence and efficacy of encryption and authentication algorithms and techniques used in mobile service and communications equipment, mobile devices, and mobile operating systems and software.

Understanding Cybersecurity of Mobile Networks Act

This bill requires the Office of Management and Budget and the Council of Economic Advisers to provide an inflation estimate for each executive order that is projected to cause an annual gross budgetary or economic effect of at least $1 million.
The estimate must determine whether the executive order will have
- no significant impact on inflation,
- a quantifiable inflationary impact on the Consumer Price Index or the Producer Price Index, or
- a significant impact on inflation that cannot be quantified at the time the estimate is prepared.
The estimate must also (1) incorporate the inflationary impact of the debt servicing costs associated with the executive order; and (2) take into account the spending patterns of military personnel and of residents of non-metropolitan areas, including rural areas and farm households.
The requirements do not apply to executive orders that (1) provide for emergency assistance or relief at the request of any state or local government or an official of the government, or (2) are necessary for national security or the ratification or implementation of international treaty obligations.

This bill generally prohibits school athletic programs from allowing individuals whose biological sex at birth was male to participate in programs that are for women or girls. Specifically, the bill provides that it is a violation of Title IX of the Education Amendments of 1972 for federally funded education programs or activities to operate, sponsor, or facilitate athletic programs or activities that allow individuals of the male sex to participate in programs or activities that are designated for women or girls. (Title IX prohibits discrimination on the basis of sex in federally funded education programs or activities, including in public elementary and secondary schools and in colleges and universities.) Under the bill, sex is based on an individual's reproductive biology and genetics at birth. The bill does not prohibit male individuals from training or practicing with programs or activities for women or girls as long as such training or practice does not deprive any female of corresponding opportunities or benefits. The Government Accountability Office must report on the benefits for women or girls in single-sex sports that would be lost as a result of male participation. In particular, the report must document the negative psychological, developmental, participatory, and sociological effects of male participation on girls.

This bill addresses issues regarding immigration and border security, including by imposing limits to asylum eligibility.
For example, the bill
- requires the Department of Homeland Security (DHS) to resume activities to construct a wall along the U.S.-Mexico border;
- provides statutory authorization for Operation Stonegarden, which provides grants to law enforcement agencies for certain border security operations;
- prohibits DHS from processing the entry of non-U.S. nationals (aliens under federal law) arriving between ports of entry;
- limits asylum eligibility to non-U.S. nationals who arrive in the United States at a port of entry;
- authorizes the removal of a non-U.S. national to a country other than that individual's country of nationality or last lawful habitual residence, whereas currently this type of removal may only be to a country that has an agreement with the United States for such removal;
- expands the types of crimes that may make an individual ineligible for asylum, such as a conviction for driving while intoxicated causing another person's serious bodily injury or death;
- authorizes DHS to suspend the introduction of certain non-U.S. nationals at an international border if DHS determines that the suspension is necessary to achieve operational control of that border;
- prohibits states from imposing licensing requirements on immigration detention facilities used to detain minors;
- authorizes immigration officers to permit an unaccompanied alien child to withdraw their application for admission into the United States even if the child is unable to make an independent decision to withdraw the application;
- imposes additional penalties for overstaying a visa; and
- requires DHS to create an electronic employment eligibility confirmation system modeled after the E-Verify system and requires all employers to use the system.

Secure the Border Act of 2023

This bill addresses fraud and overpayments of pandemic unemployment insurance (UI) benefits, including by providing incentives for states to investigate and recover overpayments of these benefits.
Specifically, the bill allows states to retain 25% of any recovered fraudulent overpayments. These retained funds may be used for modernizing unemployment compensation systems and information technology, reimbursing administrative costs, hiring fraud investigators and prosecutors, and for other program integrity activities.
Additionally, the bill allows states to retain 5% of any overpayments of regular and extended UI benefits. A state must, in order to retain these overpayments, certify that it has met certain conditions for data matching.
Next, the bill extends from 3 to 10 years the time during which states can recover overpayments of pandemic UI benefits.
Further, the bill extends flexibilities for states to hire temporary staff on a noncompetitive basis to identify, pursue, and recover fraudulent overpayments under federal pandemic unemployment compensation programs authorized by the Coronavirus Aid, Relief, and Economic Security Act (CARES Act).
The bill also extends from 5 to 10 years the statute of limitations for federal criminal charges or civil enforcement actions related to UI fraud.
Finally, the bill repeals a section of the CARES Act (as amended by the American Rescue Plan of 2021) that provided funding for UI program integrity activities.

This bill requires the National Institute of Standards and Technology (NIST) to support research and other activities related to identifying xylazine (a compound used in veterinary medicine as a nonopioid tranquilizer), novel synthetic opioids, and other emerging substances of concern.
