Fair Maps Act

This bill requires the Legislative Audit Bureau to conduct a performance audit of election processes following a general election. The bill also requires the Elections Commission to assist the counties and municipalities with the audit. Under the bill, immediately following the state certification of the election results, the commission randomly selects four counties and one city and one village from each of those counties, except that one of the counties must be one of the ten most populous counties in the state. LAB then conducts its audit in the municipalities selected by the commission.

This bill increases the amount of the state credit that an individual may claim by increasing the employment-related expense limitation to $10,000 for one qualifying dependent and $20,000 for two or more qualifying dependents.

This bill creates a sales and use tax exemption for precious metal bullion. The bill defines “precious metal bullion” as coins, bars, rounds, or sheets that contain at least 35 percent gold, silver, copper, platinum, or palladium.

Precious Metal Tax Exemption

Under current law, the farmland preservation tax credit may be claimed for land engaged in agricultural use, if the land is subject to a farmland preservation agreement or located in a farmland preservation zoning district, or both. The credit must be claimed on a form prepared by the Department of Revenue (DOR), on which, among other items, a claimant must certify the number of qualifying acres for which the credit is claimed.

For tax years beginning after December 31, 2022, 2023 Assembly Bill 480 specifies that no credit may be claimed for any qualifying acreage on which a photovoltaic solar energy system is located, unless the solar energy system qualifies as an accessory use, as defined by law.

Farmland Preservation Tax Credit

AB1089 adjusts the interest rates applied to certain taxes and fees which are managed by the Department of Revenue. In current law late payments may incur a 12% annual interest rate.  A refund for an overpayment to the DOR receives a 3% interest rate. This bill provides provisions for the interest rate on late payments to decrease to 6% and for overpayment refunds to Increase to 6%.

Senate Bill 374 requires the Department of Revenue (DOR) to conduct a study on the effects of instituting income tax reciprocity between Wisconsin and Minnesota, in conjunction with the Minnesota Department of Revenue, according to procedures specified in the bill. SB 374 establishes requirements applicable to any income tax reciprocity agreement between Wisconsin and Minnesota, including that it be approved by both the Governor and the Joint Committee on Finance.

	This bill prohibits political subdivisions from expending moneys of the political subdivision for the purpose of making payments to individuals under a guaranteed income program. “Guaranteed income 	program” is defined under the bill to mean a program under which individuals are provided with regular periodic cash payments that are unearned and that may be used for any purpose. Programs under which an individual is required to perform work or attend training are not “guaranteed income programs” under the bill.

AB438 and AB439 allocate $500.8 million over 27 years to repairs and upgrades of the Milwaukee Brewers Stadium.  

The $500.8 million is made up of $365.8 million state funds and $135 million in local contributions. This bill also requires American Family Field to enact an added ticket fee which is hoped to bring in $20.7 Million to repair and upgrade efforts.

	This bill requires each public school, including a charter school, to report any incident that occurs in a school building or on school grounds to local law enforcement. If 100 or more 	incidents occur during a school semester, and at least 25 of those incidents result in an arrest, the school must, no later than the first day of the next school year, employ or contract for the employment of a law enforcement officer as an armed school resource officer (SRO) to work at the school.

	The bill requires that the state crime laboratories begin processing a sexual assault kit within five business days of receipt and complete processing it within 60 calendar days after beginning. The timeline applies only to the following: 1. Kits of a person who has consented to analysis by reporting the sexual assault if the perpetrator of the sexual assault is unknown and there is a threat to public safety. 2. Kits containing evidence collected from a sexual assault examination performed as part of the investigation of a suspicious death.

	Under this bill, the term “sexual contact” is amended to  include when the victim is made to touch the ejaculate, urine, or feces of any person upon instruction from the perpetrator, upon the use or threat of force or violence by the perpetrator, or upon an intentional act of the perpetrator, if the purpose is to sexually degrade or sexually humiliate the victim or sexually arouse or sexually gratify the perpetrator.

2023 Wisconsin Act 61

	This bill reorganizes the carjacking crimes under their own statutory section titled “Carjacking” and changes the statutory references to the carjacking statutes so as to maintain current law. This bill also increases the penalty for carjacking from a Class C felony to a Class B felony 	if the person possesses a weapon and uses or threatens to use force or the weapon. The penalty for a Class C felony is a fine that is not more than $100,000 or imprisonment for not more than 40 years, or both. The penalty for a Class B felony is imprisonment for not more than 60 years.

2023 Wisconsin Act 10

Under current law, the Higher Educational Aids Board (HEAB), University of Wisconsin System (UWS), and Wisconsin Technical College System (WTCS) oversee several grant and loan programs for minority students. Current law also requires the Medical College of Wisconsin (MCW) and the Marquette University School of Dentistry (MUSD) to each make every effort to ensure that at least five percent of their total enrollments consist of minority students as a condition of certain state assistance.

2023 Assembly Bill 554 modifies these programs so that, rather than apply to minority students, they instead apply to disadvantaged students. The bill does not define the term “disadvantaged” but does provide that in determining whether a student is disadvantaged, the student’s race, ethnicity, national origin, gender, sexual orientation, or religion may not be considered either directly or indirectly.
