Yes. New Hampshire protects the secrecy of individual ballot selections. Election officials maintain records showing who is registered and who participates in elections, but those records do not reveal how an individual marked their ballot.

State election laws establish procedures designed to protect voting privacy while maintaining accurate registration records and documenting election participation. These requirements apply to the administration of elections throughout New Hampshire.

The main categories of election information include:

– Ballot selections: Individual voting choices are protected through secret ballot procedures.

– Voter registration information: Certain identifying details appear on publicly accessible voter checklists.

– Voting participation records: Election records may show whether someone voted in a particular election.

– Confidential registration information: Additional personal information receives statutory protection from ordinary public disclosure.

– Protected voter records: Certain eligible individuals qualify for additional confidentiality safeguards.

These categories serve different administrative purposes. Public access to registration information does not mean that personal ballot selections become public records.

Is Your Vote Private in New Hampshire?

No. New Hampshire’s election procedures protect the confidentiality of how individual voters mark their ballots. Although election results are publicly reported, those results do not identify the selections made by particular voters.

RSA 658:9 requires polling places to provide voting booths arranged so individuals can mark ballots without being observed. Additional requirements under RSA 659 govern ballot handling and voting procedures.

After voting, ballots are collected and counted according to established election rules. Official results identify totals rather than providing a record connecting each voter’s identity with their selections.

Ballot preservation and recount procedures also operate under statutory requirements. These processes support election administration without creating a publicly accessible list of individual voting choices.

Voters can therefore distinguish between election transparency and personal ballot confidentiality. Public reporting of election results does not eliminate the secrecy of individual ballots.

Are Your Ballot Choices Public Records?

New Hampshire maintains voter checklists containing information necessary to administer elections and determine voter eligibility. Certain checklist details are classified as public information under RSA 654:31-a.

Publicly available checklist information generally includes:

Registered voter’s full name.

Domicile or residential address.

Mailing address, when applicable.

Town or city of registration.

Registration affiliation information, if applicable.

These details help election officials maintain accurate voting records and allow the public to review specified registration information under statutory procedures.

However, public checklist access does not provide unrestricted access to every document submitted during registration. New Hampshire separates basic checklist information from additional records containing confidential personal details.

What Voter Registration Information Is Public?

Yes. New Hampshire maintains voter participation records that may identify whether a registered individual participated in an election. This information is commonly described as voter history.

Participation records help election officials maintain accurate election records and document voter activity. Under RSA 654:31, certain authorized recipients may obtain voter history information through the procedures established by law.

Voter history can include whether a person participated in a particular election. For primary elections, certain records may also identify the primary in which a voter participated.

However, these records do not disclose individual ballot selections. A record showing that someone voted does not reveal which selections they made.

This distinction is especially important when reviewing election-related information from public sources. Participation and ballot choices are separate types of information with different confidentiality protections.

Can Someone See Whether You Voted?

Voting history documents election participation, while ballot choices reflect the selections marked on an individual ballot. New Hampshire maintains these categories separately.

A participation record may indicate that a person voted in a general election. It does not identify which selections appeared on that person’s completed ballot.

Likewise, registration information may identify the municipality where someone is registered without revealing how they voted.

The difference can be summarized as follows:

– Registration records establish a person’s place on the voter checklist.

– Participation records document whether an individual voted.

– Ballot records support counting and election administration.

– Individual ballot selections remain protected by secret ballot procedures.

Someone reviewing publicly accessible voting information should not interpret participation records as evidence of particular ballot choices.

What Is the Difference Between Voting History and Ballot Choices?

New Hampshire establishes several procedures designed to protect voters while they mark and submit ballots. These requirements help preserve privacy throughout the voting process.

RSA 659:15 directs voters to proceed to a voting booth or privacy screen after receiving their ballot. RSA 659:25 generally prevents another voter from occupying the same booth or privacy screen at the same time.

Additional procedures regulate how completed ballots are handled before they are counted.

Privacy protections include:

– Voting booths or screens that shield ballot marking.

– Restrictions on unauthorized access to voting areas.

– Procedures for protecting marked ballots while they are submitted.

– Requirements for ballot preservation and handling.

– Rules against intentionally displaying or specially identifying completed ballots.

New Hampshire also regulates intentionally showing marked ballots under RSA 659:35. Voters should follow official polling place instructions concerning ballot photographs and disclosure.

These rules protect individual voting privacy while allowing election officials to administer the election.

How Does New Hampshire Protect Ballot Secrecy?

New Hampshire law protects various details collected during voter registration from ordinary public disclosure.

Under RSA 654:31-a, information outside the specified public checklist fields generally receives confidentiality protection. Protected materials include certain registration forms, absentee registration records, affidavits, and contact information.

Examples of information that may receive protection include:

Telephone numbers provided for election communications.

Email addresses provided to election officials.

Additional information contained in registration applications.

Certain supporting registration documents.

Information included in absentee ballot applications.

These protections have statutory exceptions. Election officials and authorized law enforcement personnel may access certain records when necessary for permitted administrative, investigative, or legal purposes.

Confidentiality therefore does not mean that election officials are prohibited from using information needed to carry out their lawful responsibilities.

Is Personal Information on Registration Forms Confidential?

New Hampshire permits public access to specified voter checklist information, subject to the conditions established under RSA 654:31.

Local supervisors of the checklist and municipal clerks administer access to public checklists. State law also provides procedures for viewing certain information maintained in the statewide voter registration system.

However, access depends on the information requested and the applicable statutory restrictions. The complete statewide voter registration database is not generally open for unrestricted copying or disclosure.

RSA 654:45 specifically protects the centralized voter registration database while preserving lawful access to designated public checklist information.

The law also restricts certain commercial uses of checklist information. Public availability does not mean voter records may be used for every purpose.

Residents should contact the appropriate election office when requesting records rather than assuming that all election-related documents are publicly available.

Can Anyone Obtain New Hampshire Voter Records?

Yes. New Hampshire provides additional confidentiality procedures for eligible individuals whose circumstances require protection of identifying information.

RSA 654:25 allows certain voters with qualifying protective orders to request that their names and addresses be excluded from the ordinary public checklist. Election officials maintain the protected information separately under the applicable procedures.

New Hampshire also operates an Address Confidentiality Program for qualifying individuals affected by domestic violence, stalking, or sexual assault.

Eligible program participants may receive a substitute mailing address and additional protection against public disclosure of their residential information.

The protections are not automatic for every registered voter. Individuals must satisfy the applicable requirements and follow the authorized procedures.

Are There Special Confidentiality Protections for Certain Voters?

New Hampshire’s Address Confidentiality Program is administered through the Attorney General’s Office under RSA 7:41 through RSA 7:48.

The program provides qualifying participants with an authorized substitute address that can be used for certain government and mailing purposes. Its purpose includes reducing exposure of protected residential information.

Under RSA 7:46, qualifying program participants who are otherwise eligible to vote may use special absentee voting arrangements.

The law also prevents their names and addresses from appearing on publicly available registered voter lists.

Important protections include:

– Use of an authorized substitute address.

– Restrictions on public disclosure of protected information.

– Separate handling of qualifying voter records.

– Access to applicable absentee voting procedures.

These safeguards are intended for individuals who meet the program’s statutory eligibility conditions. Residents seeking protection should consult the Attorney General’s Office or appropriate local election officials.

How Does the Address Confidentiality Program Work?

New Hampshire does not provide a general option allowing every registered voter to remove all identifying information from public checklists simply by requesting privacy.

Certain registration information is public by statute, and election officials must maintain records according to state requirements.

However, qualifying individuals may receive additional protections through the protective-order provisions or Address Confidentiality Program.

Voters should distinguish between correcting inaccurate information and requesting confidential treatment. Updating an address does not automatically make that address confidential.

If registration information is incorrect, residents should contact their local clerk or supervisors of the checklist to determine the appropriate correction procedure.

Can You Remove Your Information From Public Voter Records?

Yes. New Hampshire absentee voting procedures are designed to preserve the confidentiality of individual ballot selections.

Although election officials maintain records associated with absentee ballot requests and processing, those administrative records do not publicly identify how an individual voted.

Eligible absentee voters must follow the state’s instructions for completing and returning ballots, including required affidavit and envelope procedures.

The separation between voter identification materials and completed ballot selections is an important part of maintaining ballot secrecy.

Residents should distinguish absentee ballot tracking information from the contents of a completed ballot. Tracking may establish whether voting materials were processed, but it does not reveal the voter’s selections.

Are Absentee Ballot Choices Private?

New Hampshire residents can consult several official sources when seeking clarification about voter records, ballot privacy, or confidentiality procedures.

The New Hampshire Secretary of State’s Elections Division provides guidance about voter registration, election administration, and voting requirements.

The New Hampshire General Court publishes the state’s election statutes, including RSA 654 and RSA 659. These laws explain checklist access, confidentiality requirements, and procedures protecting ballot secrecy.

Local clerks and supervisors of the checklist can answer questions concerning municipal registration records and applicable confidentiality procedures.

Individuals seeking assistance with the Address Confidentiality Program should contact the New Hampshire Attorney General’s Office.
