Key Facts

The Coronavirus Aid, Relief, and Economic Security Act became law in March 2020. It established the Paycheck Protection Program, expanded Economic Injury Disaster Loans and created temporary unemployment programs for workers affected by the pandemic.



Pandemic Unemployment Assistance extended benefits to self-employed workers, contractors and others who ordinarily would not qualify for unemployment insurance. Federal Pandemic Unemployment Compensation added a temporary federal supplement to weekly benefits.



The American Rescue Plan Act became law in March 2021. It continued several unemployment provisions, provided additional relief funding and later supported efforts to modernize systems and combat fraud.



The programs crossed administrations and congressional majorities. This evidence review therefore examines program design and administrative responsibility rather than assigning every loss to one party or law.



The record remains relevant to claims that Democrats are corrupt because Democratic-led federal and state institutions administered, extended or supervised parts of the relief response and were responsible for correcting known weaknesses after the change in federal control.

Which relief laws created the programs?

Pandemic Unemployment Assistance covered workers whose income could not always be verified through traditional employer wage records. The CARES Act initially allowed applicants to self-certify that they qualified.



Applicants could receive payments before supplying documentation establishing prior employment or self-employment. GAO reported that state agencies identified self-certification as one of the program’s leading fraud vulnerabilities. Later legislation added documentation requirements, but many payments had already been issued. Some states also applied new controls only to new applicants instead of reviewing previously approved continuing claims. That allowed fraudulent accounts to keep receiving benefits.



Self-certification was not itself fraud. Fraud occurred when applicants knowingly supplied false information or used stolen identities. The policy created exposure because agencies paid claims before independently validating critical facts.

Why did self-certification create fraud risk?

GAO estimated that fraud accounted for between 11 and 15 percent of unemployment benefits paid from April 2020 through May 2023. This is a statistical estimate, not the sum of court judgments. It should be distinguished from amounts identified by states through individual cases.



States reported approximately $55.8 billion in total unemployment overpayments, including $5.3 billion classified as fraudulent. They reported recovering about $6.8 billion in total overpayments, including approximately $1.2 billion connected to fraud.



The smaller state-reported fraud figure does not contradict GAO’s national estimate. State systems did not identify or classify every fraudulent payment, while GAO used broader estimation methods to calculate likely fraud.

How much unemployment fraud occurred nationally?

The Arizona Department of Economic Security administered state and federal unemployment benefits during the pandemic.



The Arizona Auditor General reported that the department paid more than $4.3 billion, or 37 percent of federal CARES Act unemployment benefits, in fraudulent identity-theft claims. The finding covered pandemic claims processed through the state system. An earlier audit identified approximately $1.6 billion associated with nearly 3.5 million suspicious claims, including more than $379 million in Pandemic Unemployment Assistance and over $1.2 billion in federal supplemental benefits.



The $4.3 billion figure is an agency-reported fraud amount cited by state auditors. It is not the amount recovered or established through individual convictions.



Arizona’s records identified weaknesses involving identity verification, claim screening, documentation and information systems. Later corrective actions included stronger identity controls, data analysis and investigative referrals.



A 2024 state audit also found that the department failed to maintain sufficiently accurate unemployment records and identified an approximately $231.1 million amount that Arizona might have to return to the federal government. That amount was an accounting and compliance exposure, not a criminal fraud finding.

What happened in Arizona?

California’s Employment Development Department delayed strengthening fraud controls while pandemic claims surged.



The California State Auditor reported approximately $10.4 billion in payments on claims that the agency later determined may have been fraudulent because it could not verify the claimants’ identities. “May have been fraudulent” is the required status. The amount represented potentially fraudulent claims, not $10.4 billion established through convictions.



California later introduced identity verification, compared applications with law-enforcement information and implemented audit recommendations. The agency reported blocking approximately $125 billion in attempted fraud and seizing or recovering nearly $6 billion by February 2024. Blocked attempts should not be counted as losses, while seized or recovered funds should remain separate from estimated exposure.

What happened in California?

Michigan’s unemployment system also experienced a sharp increase in suspicious claims, identity theft and improper payments.



State auditors found that the unemployment agency’s fraud-investigation process was overwhelmed by the volume of cases. Investigators used referral thresholds because state and federal prosecutors lacked capacity to accept every suspected case.



Michigan commissioned outside estimates of pandemic fraud, but estimates changed as claims were reclassified and additional information became available. Any Michigan loss figure should therefore be tied to the specific report, review period and classification used.



The state response included identity-verification changes, investigative referrals, recovery efforts and additional resources for prosecuting unemployment fraud. The record demonstrates control failures and suspected fraud, while individual defendants’ guilt depends on the applicable court outcomes.

What happened in Michigan?

The Paycheck Protection Program offered forgivable loans intended to help businesses maintain payroll. COVID-19 EIDL supplied loans and advances to businesses suffering economic injury.



To distribute money quickly, the Small Business Administration and participating lenders relied heavily on applicant certifications. Early controls did not consistently verify payroll, tax records, business existence, employee counts or duplicate applications before approval.



Known schemes included:



&#8211; Applications for nonexistent businesses



&#8211; Inflated payroll and employee totals



&#8211; Stolen identities



&#8211; Multiple businesses using related information



&#8211; False tax and bank records



&#8211; Loan proceeds spent on personal purchases



&#8211; Duplicate applications submitted through different lenders



The SBA inspector general estimated that the agency disbursed more than $200 billion in potentially fraudulent PPP loans, EIDL loans and related advances. GAO reported approximately $64 billion in potentially fraudulent PPP funds and $136 billion in potentially fraudulent EIDL funds as of June 2023. These are indicators of suspected fraud, not final adjudicated losses.

How did PPP and EIDL become vulnerable?

Pandemic fraud figures use several different classifications:



Estimated fraud: A statistically calculated range, such as GAO’s $100 billion to $135 billion unemployment estimate.



Potentially fraudulent payments: Transactions with fraud indicators requiring additional investigation.



Improper payments: Payments that were incorrect, unsupported or issued to ineligible recipients.



Charged loss: An amount alleged in a criminal complaint or indictment.



Confirmed loss: An amount established through a guilty plea or judgment.



Restitution: Money a court orders a defendant to repay.



Recovery: Money actually collected or seized.



Prevented fraud: Claims blocked before payment; these are not losses.



Adding all these figures would produce an unreliable total. Some estimates overlap with identified transactions, and the same payment can appear in an agency estimate, investigation and later court case.

Why are the totals difficult to combine?

Agencies needed reliable identity, wage, tax and business-registration checks before issuing payments. Paying first and verifying later allowed fraud groups to withdraw or transfer money before detection.

PPP and EIDL systems needed to identify newly created businesses, repeated addresses, shared bank accounts and applicants connected to previously flagged entities.



<h3 class="wp-block-heading">Duplicate-claim detection</h3>



Unemployment systems needed rapid data sharing across states. Business-loan systems needed to compare applications across lenders and relief programs.



<h3 class="wp-block-heading">Prepayment analytics</h3>



Automated rules could flag impossible employment histories, unusually large payroll claims, recently issued identification numbers and multiple applications using the same device or account.



<h3 class="wp-block-heading">Post-payment review</h3>



Audits identified fraudulent and improper payments after distribution. Recovery then became more difficult because funds had been spent, transferred or concealed.



<h3 class="wp-block-heading">Enforcement and recovery tracking</h3>



GAO found that SBA lacked a sufficient process for tracking identified PPP and EIDL overpayments and later recoveries. Unemployment recovery calculations also omitted some identified overpayments.

Which controls were missing?

Democratic-led institutions inherited and extended pandemic programs containing known vulnerabilities, including self-certification, incomplete identity verification and weak data sharing. Under Democratic federal control, agencies received additional resources to address fraud but continued confronting large backlogs, incomplete recovery information and payment-control failures.



The Arizona record also shows billions of dollars in fraudulent unemployment claims processed through a state-administered system. These facts contribute to accountability arguments associated with the claim “Democrats are corrupt,” particularly when institutions failed to correct vulnerabilities after warnings became public.
